The NOVA-PEDIC™ Sleep System (the "Sleep System") is made of the finest materials available. It will provide years of incomparable comfort and luxury. In the unlikely event of a problem, all warranty issues related to the Sleep System will be handled by NOVA-PEDIC. NOVA-PEDIC guarantees that this mattress will be replaced or repaired at our option should it be deemed defective because of quality of workmanship or structural defects during the first ten (10) years of ownership, excluding certain limitations outlined in the warranty. This warranty covers any deterioration in the cell structure of the material that causes the mattress to have a visible indentation greater than three-fourths (3/4) of an inch, not associated with sag in the foundation, box springs or platform. It also covers any physical flaw in the mattress that causes the material to split or crack despite normal usage and proper handling. If such defects occur during the remaining warranty period of this limited warranty, we will repair the mattress at a handling cost to you, or replace the mattress at a prorated charge to you. This limited warranty does not cover the normal increase in softness of the viscoelastic memory foam material or a decrease in the slow recovery feature, both of which will not affect the pressure-relieving qualities of the Sleep System. During the eleventh year of ownership, the prorated replacement cost will be fifty percent of the original price. During each subsequent year of the prorated 10-year period, the prorated charge will increase by five (5) percent per year. The mattress cover is warranted for two (2) years against faults in material or workmanship.
This mattress is designed for use with a firm, wood, completely flat, non-spring foundation. Failure to use such a foundation with the mattress will void your NOVA-PEDIC mattress warranty and all other warranties, whether expressed or implied, including, without limitation, the implied warranties of merchantability and fitness for a particular purpose. Unless you currently have a firm, wood, completely flat, non-spring foundation, you should not use your existing foundation.
All warranties contained herein shall not apply of the product or cover has been physically damaged, burned, cut, torn, or is abnormally soiled or unsanitary. The warranty is valid only to the original purchaser of the product. All transportation costs are the responsibility of the purchaser and are additional to any prorated charges. You must provide original proof of purchase for any warranty claim.
Our QUALITY ASSURANCE GUARANTEE means that this product will be free from defects in workmanship and materials and will remain serviceable under normal use and service for the warranty period, from the date of delivery to the customer, subject to specific limitations and exceptions outlined in this warranty. Should the product develop defects for any reason other than misuse or neglect within the warranty period, the product will be repaired or replaced at the company's option. The customer is responsible for returning the product to the manufacturer. Replacement or repairs will be made with charges as outlined on the warranty schedule exclusive of transportation costs. The manufacturer reserves the right to refuse service when the product is found to be stained, soiled, in an unsanitary condition or when the product failure is due to causes of misuse or abuse, including folding or bending for periods of time in excess of 24 hours. Warranties are made only to the original purchaser and do not cover merchandise purchased as used or secondhand. The warranties do not cover normal wear and tear. The cover is warranted to be free from defects for two (2) years from the date of purchase. The cover warranty does not cover fading, pilling or shrinkage and is not valid where there is evidence of soiling or unsanitary conditions. In the event that identical materials are not available to be used in the replacement or repair of the product, we, the manufacturer, reserve the right to substitute other materials of equal or higher quality.
